1. Purpose of These Terms of Service

These Terms of Service provide transparency about the rules and guidelines that govern your access to and use of our Services, including our website, Minecraft server, and Discord community. They explain:

  • What is expected of you as a user, including responsibilities and conduct guidelines.
  • How we manage, protect, and enforce rules for our website, Minecraft server, and Discord community.
  • The rights you have and the limitations on our liability.
  • How disputes will be resolved.

By using our Services, you agree to these Terms and acknowledge that they are designed to create a safe, respectful, and enjoyable environment for all members of the Mythrend Network community.

2. Agreement to These Terms

By accessing or using the Mythrend Network website, Minecraft server, and related services (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you (or the entity you represent) and Mythrend Network LLC ("Company," "we," "us," or "our"). Mythrend Network LLC operates the Mythrend Network website and Services, providing an online community and gaming platform centered on a unique Minecraft server experience. Our website serves as the hub for services such as account management, in-game rewards, community interaction, and the Mythrend Network storefront.

4. Definitions

  • "Services": The website, Minecraft server, Discord community, and any other products or services offered by Mythrend Network LLC.
  • "We," "Us," "Our": Mythrend Network LLC, the operator of the website and Services.
  • "User," "You": Any individual or entity accessing or using our Services.
  • "Content": All text, images, audio, video, graphics, and other materials made available through our Services.
  • "Account": A user profile created by registering for our Services.
  • "Third-Party Services": Services provided by external providers (e.g., Tebex, Discord, Microsoft, Cloudflare) that are integrated into or connected with our Services.
  • "Contributions": Any content, submissions, or messages you post, upload, or transmit through the Services.
  • "Virtual Goods": Any in-game items, currencies, ranks, cosmetics, or other digital products purchased or earned through the Services.

5. Our Services

Our Services include:

  • Website: The primary hub for community information, account management, support, and Microsoft OAuth integration for Minecraft account verification and login.
  • Minecraft Server: A gaming environment where players interact, play, and track in-game progress.
  • Discord Community: A platform for user and staff engagement and community discussion.
  • Additional Features: Forums, leaderboards, in-game progression systems, and other interactive elements integrated across platforms.

Access to and use of these Services are subject to these Terms and, in some cases, additional platform-specific rules (e.g., server guidelines or Discord rules).

6. Account Registration and User Representations

  • Registration: To access certain Services, you must register and create an Account using a valid Microsoft account. Account creation and login are handled exclusively via Microsoft OAuth, which directly associates your website account with your Minecraft account.
  • Accurate Information: You agree to provide true, accurate, current, and complete information and to update it promptly as necessary.
  • Account Security: You are solely responsible for maintaining the confidentiality of your login credentials. All activities conducted under your Account are your responsibility. Notify us immediately at [email protected] if you suspect unauthorized access to your Account.
  • User Eligibility: By registering, you confirm that you have the legal capacity to enter into these Terms, that you meet the minimum age requirements set forth in Section 9, and that you agree to comply with all applicable laws and regulations.
  • User Representations: You represent and warrant that all information you provide is truthful, accurate, and kept up to date. Failure to maintain accurate account information may result in suspension or termination of your Account. Optional profile fields — including Discord username, phone number, and display name — are shared publicly and are your responsibility to keep accurate and appropriate.
  • One Account Per User: You may not create or operate more than one Account without our prior written consent. Duplicate accounts created to evade penalties or bans will be terminated.

7. Intellectual Property

  • Ownership: All content, trademarks, logos, trade names, and intellectual property on our Services are owned by Mythrend Network LLC or its licensors and are protected by applicable intellectual property laws.
  • License to You: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Content solely for personal, non-commercial purposes.
  • Restrictions: You may not copy, reproduce, modify, adapt, distribute, publicly display, create derivative works from, or otherwise exploit any Content without our prior written consent. Unauthorized use may result in immediate termination of your Account and may expose you to civil or criminal liability.
  • Feedback: If you submit suggestions, feedback, or ideas regarding our Services, you grant us a perpetual, irrevocable, royalty-free license to use such feedback without any obligation to you.

8. Purchases, Payments, and Subscriptions

  • Payment Methods: Payments are processed through authorized third-party payment processors (e.g., Tebex) in U.S. dollars. We do not store your payment card information.
  • Billing: Subscription-based services automatically renew at the end of each billing cycle unless cancelled prior to the renewal date. By providing a payment method, you authorize us (through our payment processor) to charge applicable fees on a recurring basis.
  • Refunds and Cancellations: All purchases are final and non-refundable unless explicitly stated otherwise or as required by applicable law. Cancellations take effect at the end of the current billing cycle; you will retain access to subscription benefits through that date.
  • Pricing Changes: We reserve the right to change pricing at any time. We will provide advance notice of any price changes via email or announcement on our website. Continued use of a subscription-based Service after a price change constitutes your acceptance of the new pricing.
  • Taxes: You are responsible for all applicable taxes, duties, or levies arising from your purchases.

9. Age Restrictions and Parental Consent

  • Minimum Age: Our Services are intended for users 13 years of age or older. Users who are under 16 years of age in the European Union, under 16 in the United Kingdom, or under 19 in South Korea must obtain verifiable parental or guardian consent before accessing or using our Services.
  • COPPA Compliance: We do not knowingly collect personal information from children under the age of 13. If we become aware that we have collected personal information from a child under 13 without verifiable parental consent, we will take prompt steps to delete such information. Parents or guardians who believe their child has provided personal information without consent should contact us at [email protected].
  • Enforcement: Accounts that do not satisfy applicable age requirements may be suspended or permanently terminated without prior notice.

10. Prohibited Activities

You agree not to engage in any of the following activities while using our Services:

  • Violating any applicable federal, state, local, or international law or regulation.
  • Infringing the intellectual property rights of Mythrend Network LLC or any third party.
  • Cheating, hacking, exploiting bugs or glitches, or using unauthorized third-party software (including cheat clients) that provide an unfair advantage on the Minecraft server.
  • Harassing, bullying, threatening, or engaging in abusive behavior toward other users or staff members.
  • Spamming or engaging in conduct that disrupts the website, Minecraft server, or Discord community.
  • Sharing another user's personal information without their explicit consent ("doxxing").
  • Engaging in unauthorized advertising, self-promotion, or solicitation within our Services.
  • Interfering with or attempting to interfere with the security, integrity, or proper operation of our Services.
  • Impersonating any person or entity, including Mythrend Network staff or administrators.
  • Attempting to gain unauthorized access to any portion or feature of our Services, or any other systems or networks connected to our Services.
  • Using our Services to transmit malware, viruses, or any other malicious code.

Violations of this section may result in warnings, temporary mutes, kicks, temporary bans, or permanent bans depending on the nature and severity of the violation. We reserve the right to take any disciplinary action we deem appropriate at our sole discretion.

11. Chargebacks and Payment Disputes

By making a purchase through our storefront, you agree not to initiate any chargeback, reversal, or payment dispute with your payment provider without first contacting us at [email protected] and allowing us a reasonable opportunity to resolve the issue.

Unauthorized chargebacks or payment disputes may result in:

  • Immediate suspension or permanent termination of your Account.
  • Permanent forfeiture of access to all purchased products and Virtual Goods.
  • Referral to a collection agency or initiation of legal proceedings to recover owed amounts.

You agree to reimburse us for any fees, costs, or expenses (including reasonable attorneys' fees) we incur as a result of an unauthorized chargeback or fraudulent payment activity attributable to your Account.

12. User-Generated Content and Contributions

  • License Grant: By posting, uploading, or submitting any Contribution to our Services, you grant Mythrend Network LLC a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, and publicly display your Contributions in connection with the operation and promotion of our Services.
  • Your Responsibility: You are solely responsible for your Contributions and represent that they do not violate any applicable law, third-party rights, or these Terms.
  • Removal: We reserve the right, but not the obligation, to monitor, edit, or remove any Contribution at our sole discretion that we determine to be harmful, illegal, offensive, or in violation of these Terms, without prior notice.
  • No Endorsement: We do not endorse or assume any liability for any Contributions posted by users.

13. Permitted and Prohibited Client Modifications

We support a fair and enjoyable gameplay experience for all users. The following guidelines apply to Minecraft client modifications:

  • Permitted modifications include performance-enhancing or quality-of-life mods that do not provide a gameplay advantage (e.g., OptiFine, Sodium, Iris, FPS-boosting mods, and approved cosmetic mods such as those from the Lunar Client or Badlion Client approved lists).
  • Prohibited modifications include any client-side modification that provides an unfair advantage over other players, including but not limited to: aim assistance, kill aura, X-ray, flight hacks, speed hacks, auto-clickers, schematica printer mode, and any other modification that automates gameplay or bypasses server-enforced rules.
  • When in doubt, contact our support team before installing a modification. Use of any modification found to violate these guidelines — whether or not explicitly listed above — may result in account suspension or permanent termination.

14. Virtual Goods and In-Game Assets

  • Nature of Virtual Goods: All purchased items, currencies, ranks, cosmetics, and other digital products are virtual goods with no real-world monetary value and no physical form. You do not own Virtual Goods; you are granted a limited, revocable license to use them within our Services.
  • Changes and Balancing: The functionality, appearance, and associated perks of Virtual Goods may be modified, adjusted, or removed as part of server updates, balancing, or other operational decisions. We will endeavor to provide reasonable notice of significant changes.
  • Non-Transferability: Virtual Goods may not be sold, traded, or transferred outside of channels explicitly approved by Mythrend Network LLC. Any unauthorized transfer is void.
  • No Cash Value: Virtual Goods have no cash value and cannot be redeemed for real-world currency under any circumstances.

15. Server Downtime, Maintenance, and Data Loss

  • Scheduled and Unscheduled Downtime: We may interrupt Services from time to time for maintenance, upgrades, or due to technical failures. We will endeavor to provide advance notice of scheduled maintenance where practicable.
  • Data Loss: While we maintain backups, we cannot guarantee that user data will be preserved in all circumstances. User data may be corrupted, lost, or rolled back due to technical issues.
  • No Liability: Mythrend Network LLC is not liable for any inconvenience, loss of in-game progress, or damages arising from downtime, maintenance, or data loss, to the fullest extent permitted by applicable law.

16. DMCA and Copyright Complaints

If you believe that any Content on our Services infringes your copyright, please send a written notice to [email protected] that includes:

  • A description of the copyrighted work you claim has been infringed.
  • Identification of the specific material on our Services that you claim is infringing, with sufficient detail to allow us to locate it.
  • Your contact information (name, address, telephone number, and email address).
  • A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
  • Your electronic or physical signature.

We will review valid DMCA notices and respond in accordance with applicable law, including, where appropriate, removing or disabling access to the allegedly infringing content.

17. Services Management and Enforcement

  • Monitoring: We reserve the right, but not the obligation, to monitor and review all activity and Content on our Services to ensure compliance with these Terms.
  • Disciplinary Action: Access to our Services may be suspended or terminated at our sole discretion for violations of these Terms. We reserve the right to take any other action we deem appropriate, including cooperation with law enforcement authorities.
  • Appeals: If you believe a disciplinary action was taken in error, you may submit an appeal through our support channels. Appeals will be reviewed by our moderation team, and decisions on appeals are final.

18. Disclaimers and Limitation of Liability

  • "As Is" Basis: OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
  • Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MYTHREND NETWORK LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICES EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS YOU PAID TO US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
  • Assumption of Risk: You acknowledge that your use of the Services is at your own risk.
  • Termination Rights: We may suspend or terminate your access to the Services at any time, for any reason or no reason, with or without notice.

19. Indemnification

You agree to indemnify, defend, and hold harmless Mythrend Network LLC and its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of or inability to use the Services; (b) your violation of these Terms; (c) your violation of any third-party rights, including without limitation any intellectual property rights or privacy rights; or (d) any Contributions you submit to or through the Services.

20. Governing Law and Dispute Resolution

  • Governing Law: These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the State of West Virginia, without regard to its conflict of law provisions.
  • Informal Resolution: Before initiating any formal dispute, you agree to contact us at [email protected] and provide a written description of the dispute, your desired resolution, and your contact information. We will attempt to resolve the dispute informally within thirty (30) days of receipt.
  • Binding Arbitration: If a dispute cannot be resolved informally, it shall be submitted to binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, with proceedings conducted in West Virginia or, at your election, by video conference. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
  • Class Action Waiver: YOU AND MYTHREND NETWORK LLC EACH WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS-WIDE ARBITRATION, OR REPRESENTATIVE ACTION. ALL DISPUTES MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY ONLY.
  • Opt-Out Right: You may opt out of the binding arbitration agreement by sending written notice to [email protected] within thirty (30) days of first accepting these Terms. Your notice must include your name, your Account username, and a clear statement that you opt out of arbitration.
  • Exceptions: Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.

21. International Users and Data Transfers

Our Services are operated in the United States. If you are accessing the Services from outside the United States, you do so at your own risk and are responsible for compliance with local laws. By using our Services, you consent to the transfer, processing, and storage of your information in the United States, where data protection laws may differ from those in your jurisdiction.

If you are a resident of the European Economic Area ("EEA"), United Kingdom, or Switzerland, please review our Privacy Policy for information about how we handle your personal data and your rights under applicable data protection laws, including the General Data Protection Regulation ("GDPR").

22. Third-Party Services and Links

Our Services may contain links to or integrations with third-party websites, services, or applications (e.g., Discord, Tebex, Microsoft). These third-party services are governed by their own terms of service and privacy policies, and we are not responsible for their content, practices, or policies. Your use of any third-party service is at your own risk.

23. Miscellaneous

  • Severability: If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
  • Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Mythrend Network LLC.
  • Force Majeure: Neither party shall be liable to the other for any delay or failure to perform obligations due to causes beyond their reasonable control, including acts of God, natural disasters, war, government action, internet outages, or third-party service failures.
  • Assignment: You may not assign, transfer, or delegate any of your rights or obligations under these Terms without our prior written consent. We may assign these Terms, in whole or in part, at our sole discretion, including in connection with a merger, acquisition, or sale of assets.
  • Entire Agreement: These Terms, together with our Privacy Policy and any additional guidelines incorporated by reference, constitute the entire agreement between you and Mythrend Network LLC with respect to your use of the Services, and supersede all prior and contemporaneous agreements, communications, and understandings.
  • Headings: Section headings are for convenience only and shall not affect the interpretation of these Terms.

24. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will provide notice via email to the address associated with your Account (if applicable) or via a prominent announcement on our website at least seven (7) days before the changes take effect. Your continued use of the Services after the effective date of any revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must stop using the Services.
